Have you considered what you might be doing if you apply for that tax stamp that the ATF now requires of you, if you own a pistol with a brace on it?
You could be/are setting yourself up to be a felon.
The ATF is on record saying that, if you don’t finish your application within that 120 day period, and if you don’t pass the background check within that time frame, in the ATF’s eyes, you are already a felon. 120 days to the ATF is a coffee break. This is a process that guarantees to take years. In the meanwhile, they will have no problem with arresting you on a bogus charge, very costly and time consuming court time, and possibly prison time. Look at it this way. If you already have the pistol with a stabilizing brace on it, and you know the ATF just came out with a rule that bans said item, if you don’t seek out a lawyer first, you are already one foot in prison. Admitting to a felony, that you never committed, is only going to make your life miserable. Expect it! As my title says, if you trust the ATF to do the right thing, being all warm and fuzzy to keep you from being a felon, you might as well go and kiss a rattlesnake. I would dare say the equivalent to a visit, in handcuffs, with a US Attorney and an ATF agent would be equally as painful as the viper’s venom. Why would you wish that on yourself? I might rather get bitten by the rattlesnake, because at least the hospital has antivenom.
All you have to ask around, to anyone who has applied for a tax stamp for any NFA device, from a suppressor to a machine gun, or any of the rest, is how long does it take for the ATF to get around to approving the stamp. That process is so slow, up to two years for some, and that’s if you pass the process. When you normally apply for a suppressor tax stamp, or any tax stamp, it is before you own said suppressor. It is a process that no law abiding American citizen should be required to go through. We are a free country, aren’t we? If this rule was about keeping something out of the hands of a criminal, it would have not been geared toward those who followed the law, that this AR pistol with a brace is legal. There is nothing “Crime prevention” about this. It is about making us criminals.
Say you are wanting to build a short barreled rifle, which should be a no-brainer, you can’t change the barrel until you have received approval from the ATF, and that is the tax stamp you get in the mail. I’m leaving out all the hoops you have to jump through, just to keep it simple enough for anyone to understand, because it is not an easy task, no matter who helps you do it.
Enter this new rule about pistols with braces. You already are in possession of it, which automatically makes you a felon, regardless of what the ATF says. If you apply for the tax stamp, and fail, or it goes past that 120 day period, and you should know it will , you just admitted to owning something that they claim is now an NFA item. Is the picture more in focus, now? Could there be another intent by the ATF? Sure! A politically charged agency, with the sole intent of taking your firearms away? I think so. This is just one step.
No, I am not a lawyer, but I don’t care. Anyone who can’t understand how stupid that is, to blindly accept this agency as the gospel, needs their heads examined. To apply for something as vague and arbitrary, especially since the same ATF said, until about a month ago, that the device that is now that NFA weapon was perfectly legal to own because it was not an NFA weapon? They said it was legal to own, for over a decade. They want a do over, I guess, but they broke the law to do this over. Do not fall for this trap. That is what it is. A trap! What I call this nightmare is a Catch-22. If you do apply, and the time runs out on your application, you lose. If you don’t apply, and they find out, you lose, but only if you are too stupid to take the pistol brace off, and wait for the lawsuits that are already filed.
They don’t really want a do-over. They were given marching orders by those in authority, and were happily willing to break the law in order to do this.
Because they want to disarm everyone of us.
We are not to break the law. In case you hadn’t noticed, the same applies to the ATF, Merrick Garland and Demented Joe Biden. They broke the law. It is blatantly obvious that they did, and all that needs to be resolved is for one federal judge to decide to slap the government down for breaking the law. I think the odds of that happening is a pretty awesome one.
The government is trying everything it can to put fear in you, so you will submit to their unlawful acts. Don’t do it. Don’t go bragging about your shiny toys, and just take a bit of time to let this blow up in the government’s face.
Because it is the government who is the felon, not you.
Presently, twenty five states have joined on to one of the lawsuits against the government over this rule. Unless you believe Obama and his “fifty seven states”, that is half the country who are fighting this garbage, along with some pretty sharp lawyers and plaintiffs. Let this work out in the courts. It may even have implications that could kill off the National Firearms Act of 1934, which has yet to have the endoscopy it deserves.
If the government can get away with this, we are already prisoners.
Call your representatives and let them know how you feel about this. This law was solely to do as Ayn Rand said about writing laws. It was to create more criminals, because that is the tool for an oppressive state to have control over you. That is what all gun grabbing laws are. Nothing else

They’ll NEVER stop. If this gets shot down, they’ll come up with another, more moronic requirement that they will try to foist on law-abiding firearms owners, and it will go on and on. The Government has nearly unlimited funds (our tax dollars) to invoke and defend this crap and they’re willing to keep it up forever.
I have no doubt that they will never quit trying to take our guns. I just want the Supreme Court to make one or two more key decisions, so the people have the full capability to meet this government head on. We are that close to violence, and I don’t want some idiot fed with a badge trying to get ,ore in the way than the law allows.
When the pistol brace rule gets taken down, the rest that falls, of that NFA, comes very close to the cliff edge.
