The Preamble to the Constitution contains this lofty line: “[To] promote the general welfare…,”. Article I, Section 8 finds similar wording: “The Congress shall have the power to … provide for the … general welfare of the United States….” These General Welfare notations have been interpreted to mean the federal government has the right/power – and duty/obligation – to use public money to feed, clothe, evacuate, repair and/or provide money to victims of natural or other disasters.
Thus, federal government assistance should be provided to those who suffer significant misfortune, but to do so requires specific legislation – acts of Congress as per the Article I and again specified in the 10th Amendment. In other words, the President or any federal agency is not permitted to disperse aid to any person, state or private entity sans a law allowing such expenditures.
Of course, the reality is these mandates have been over-looked each time catastrophe strikes … or POTUS wishes to endear himself to the voters by executive order such as arbitrarily forgiving debt for select classes of citizens – in direct contravention to a SCOTUS ruling and the above noted Constitutional provisions.
