Update on U.S. Postal Service Lawsuit

The ten-year battle continues with the US Postal service over their unilateral, arbitrary and capricious refusal to allow my mailbox to be at my property line. This violates my constitutional equal rights protection. They declared the road unsafe and threatened to halt all mail unless I moved the box ¼ mile to a cluster box location. Thus, if packages don’t fit in the box, it’s a 10-mile round trip to the local post office. This is problematic now that I’m in my mid-80s and ordering many mail order products. Only the owner of the road/right-of-way (the township) has the authority to make such declarations (except maybe Kings?).

The USPS response to my suit: “The 14th Amendment applies to state actors, not the federal government, and …  USPS’s sovereign immunity.” In other words, the USPS is saying they are the King, as in the King can do no wrong.

UPS, FedEx, and other carriers regularly make deliveries on this 100-year-old road that has no record of accidents. If the USPS is allowed to determine the safety of a public road, then any agency – FBI, ATF, DOE… – could also, willy-nilly, close public roads.
