In 2017 the local postmaster intentionally, unilaterally, arbitrarily and capriciously declared the public road to my property unsafe and thus stopped delivering mail until I moved the box to a cluster-box location – precluding delivery of packages too large for the box to be delivered to my door. This action was a direct result of a then-neighbor who had refused to yield her vehicle to the carrier on this section of the public road, a violation of both state and federal law. No complaint was made to any LE agency.
After going through the USPS appeal process, I filed suit claiming they violated my 5th Amendment rights. The prima facie evidence includes other roads that are just as narrow, twisty and hilly all throughout WV, KY, OH, IN…. The court dismissed the suit claiming they didn’t have jurisdiction…but the USPS also claimed it lacked jurisdiction – a real Catch 22.
If the USPS prevails, they will have the right and power to move everyone’s mailbox to a cluster location. The Question is: Do we want service or low postage? Constitutional practiced attorney, Rick Ganulin, believes this case is so important he will be appealing pro-bono.
