The U.S. government has done what it always does when a new technology shows up faster than policy, cheaper than procurement, and smarter than the org chart. It reached for a clipboard.
Over the past two years, federal agencies have quietly moved from curiosity about artificial intelligence to formal requirements to identify, inventory, and govern its use. If an AI system influences decisions, analysis, or operations—especially if that system is commercial, third-party, or not owned by the government—someone is now expected to document it. Contractors are learning this lesson the fastest. If AI touches a deliverable, an auditor somewhere wants to know about it.
This is not an innovation strategy. It is institutional self-preservation.
Historically, governments do not regulate new technologies because they understand them. They regulate them because they don’t, and because they sense a shift in power. AI does not merely transmit information faster. It produces analysis, drafts language, summarizes intelligence, and accelerates judgment. Those functions have long been the protected territory of bureaucracies. When a machine starts doing staff work, leadership pays attention.
This pattern is not new. The printing press terrified authorities because it bypassed clerical control. The telegraph collapsed distance and disrupted diplomacy. Radio unsettled governments because information escaped geographic boundaries. Cryptography alarmed them because secrets could be kept from the state. The internet flattened power structures entirely. Every time, regulation followed fear, not mastery.
The federal government’s own record of adopting technology reinforces this instinct. Email, introduced in the 1990s, didn’t just speed communication. It permanently recorded it. Chains of command flattened, informal guidance became discoverable, and “reply all” became a weapon of mass frustration. The response was not cultural adaptation but policy proliferation, records management rules, and training slides explaining how not to destroy democracy with Outlook.
Enterprise IT systems in the 2000s promised efficiency and delivered billion-dollar overruns, rigid workflows, and interfaces designed to serve compliance rather than humans. Cloud computing in the 2010s arrived late and wrapped in so many layers of authorization that agility became theoretical. In every case, innovation moved faster than governance, and governance responded by slowing everything down.
Artificial intelligence followed the same trajectory, only faster. Between 2020 and 2023, AI systems leapt from research curiosities to everyday tools. Analysts used them to summarize data. Staff officers used them to draft memoranda. Contractors used them to accelerate deliverables. None of this required permission. It worked immediately. That was the problem.
Policy soon followed. The AI in Government Act of 2020 established the idea that agencies should know what AI they were using. Subsequent executive guidance expanded the concept under the banner of “responsible AI.” By 2024 and 2025, formal Office of Management and Budget memoranda required agencies to maintain inventories of AI use cases, classify systems by impact, and apply governance frameworks. High-impact AI systems received special scrutiny. Commercial and third-party tools received even more.
The emphasis on systems not owned by the government is revealing. Liability lives there. If an AI system influences benefits, enforcement, hiring, or prioritization, courts will ask who used it, how it was trained, and whether decisions can be explained. Congress will ask how much it costs and whether it’s secure. Inspectors General will ask whether policies were followed. Reporting is not about stopping AI. It is about building a paper trail.
This is where government habitually goes wrong. Instead of regulating outcomes, it regulates tools. Instead of focusing on whether AI makes coercive or rights-affecting decisions, it risks fixating on whether AI was used at all. The difference matters. Regulating AI as a decision authority is legitimate governance. Regulating AI as a productivity aid is bureaucratic overreach.
Fear blurs that distinction. AI feels different because it challenges a cognitive monopoly. It scales analysis. It compresses staff work. It exposes uncomfortable manpower math. When a handful of people with good tools can do what once required an office full of analysts, institutions respond defensively.
That response is dressed up as transparency, trust, and governance. Some of it is necessary. Some of it is inevitable. Much of it is familiar. Governments have always struggled to keep pace with technologies that decentralize power. The instinct is not malicious. It is structural.
The risk is that compliance becomes the objective instead of capability. That regulation chases the appearance of control rather than the reality of impact. That innovation goes underground while paperwork multiplies above it.
AI is not the first technology to trigger this reflex, and it will not be the last. History suggests the same ending every time. The technology moves forward. The policy lags behind. The clipboard keeps swinging. The only real question is whether this time the government can learn from its own past and govern effects instead of tools, outcomes instead of fear, and results instead of process.
If not, artificial intelligence will do what every transformative technology has done before it.
It will move on, with or without permission, while Washington is still filling out the form explaining why it was used.
