KBJ: The DEI Gift That Keeps on Giving

President Asterisk didn’t appoint Ketanji Brown Jackson (KBJ) to the Supreme Court for her intellectual prowess, legal acumen, or incisive jurisprudence. He appointed her for the sole reason that she is a black woman. He even said so … with pride. Well, Justice Jackson has become a testament to DEI – just not in the way Joey SoftServe intended.

KBJ’s character and intellect has been on display since the moment of her appointment. During her confirmation hearing, Senator Marsha Blackburn asked her to define “woman.” Judge Jackson replied: “I can’t … Not in this context. I’m not a biologist.”

That answer struck me as a bald-faced lie impudent deception, publicly stated, under oath, while seeking membership on a body who’s only legitimacy is its integrity. It should have instantly disqualified her from consideration as a Supreme Court Justice. But the putzes in the Senate confirmed her anyway – because of course they did. Every vote in favor of her confirmation was an illustration of the lack of integrity endemic in our elected “public servants”.

But after several years of reading nonsensical opinions written by Justice Jackson, I’m reminded of Hanlon’s razor: “Never attribute to malice that which is adequately explained by stupidity.”

Have I been guilty of judging the book by its cover, without reading its contents? I’m starting to think I was wrong about her alleged perjury.

Is it possible that Jackson didn’t lie under oath at all during her confirmation? Could she in fact be an honest idiot – too dumb to know what a woman is? That would make her the ultimate DEI hire – just as Scranton Joe promised.

Her legal reasoning, since clocking it at the building with the blindfolded lady out front, supports that conclusion. Her opinions have been an exercise in irrationality. In fact, the only person who is apparently pleased with KBJ’s membership on the court is Justice Sonia Sotomayor. Anonymous leaks from Sotomayor’s clerical staff report that she occasionally chants: “I’m not the worst!” The “anymore” qualifier being implied.

KBJ’s most recent illustration of idiocy was delivered with the Callais v. Louisiana decision. The Supreme Court had already decided that Louisiana’s congressional district map was an unconstitutional racial gerrymander. Yet Jackson was irate that the court was expediting its certification of the decision to give the state time to fix the problem before the midterm election. It seems Justice Jackson thinks the court’s customary snail pace is more critical than letting the people of Louisiana vote for candidates who actually represent them. So much for defending democracy.

As constitutional scholar Jonathan Turley said:

Jackson stood alone in demanding that the unconstitutional districts be effectively preserved for the purposes of this election — guaranteeing Democratic seats in the midterms that could be lost in nonracially discriminatory districts.

Even Justices Kagan and Sotomayor dissented from Justice Jackson – both allegedly chanting: “We’re not the worst!”

Justice Jackson’s position on the matter was so asinine, that Justice Alito felt compelled to call out her cluelessness. He wrote that her opinion on the matter was “baseless and insulting.”

Upon reading Alito’s rebuttal to Jackson, I had a flashback to a 1970’s rerun of Saturday Night Live. In a comedy sketch about a point/counterpoint news broadcast, Jane Curtin provided a lengthy analysis of a breaking news story. Chevy Chase then rebutted with the simple rejoinder: “Jane, you ignorant slut.”

Yup, I think that’s what Justice Alito meant.
