
Earlier this month, in Part XXXI we remained once again in the realm of song parody, and sang along with our smart TVs as we saw the sign of the Z slashed across Ukraine. In the course of the discussion, though, it has been asked regarding this and almost every other foreign and domestic policy failure whether Joe Biden is truly just incompetent or managing to accomplish what he is setting out to do. When confronted with this choice, I usually answer “Yes.”
As I consider the legislative acumen demonstrated during his Senate career from 1973 to 2009, I am most famously reminded of his 1992 creation and articulation of the Biden Rule. Delaware’s junior senator at the time was the head of the Senate Judiciary Committee, and announced that should a vacancy occur during the final year (1992) of George H.W. Bush’s term, that the Senate would not entertain the nomination, as the president and senate majorities were held by different parties, and the upcoming presidential election should make a determination as to who should fill the seat.
At the time, no democrat since Lyndon Johnson had placed anyone on the Supreme Court (not that it mattered, as weak republican appointees continued to abound). The point was soon moot in any event, though, as no vacancies were created that year. Bill Clinton went on to win the presidency, and filled the next two slots with Steven Breyer and Ruth Bader-Ginsberg.
The Biden Rile lay dormant for the next 24 years, when Antonin Scalia suddenly was found death at the beginning of the 2016 presidential election year, and Barack Obama announced that he wished to fill the vacancy with Merrick Garland. At the time, the Senate had a republican majority, and the majority leader Mitch McConnell reached back into the trashcan of history and wiped off the old Biden Rule, and left Merrick Garland on the sidelines.
Once again, the ingenuity of the former senate judiciary committee chairman, who was serving as vice president at the time, was on display. The American electorate was given a chance to weigh in, and the next three Supreme Court picks were made by Donald Trump.
Biden managed to outdo even former democrat senate majority leader Harry Reid and his nuclear option with the Biden Rule. His tactical genius managed to keep Merrick Garland away from a lifetime appointment to the highest court in the land, and make him available to serve as his stooge of an attorney general.
Anyone who has paid attention to what Garland has done as the head of the US Department of Justice should be thankful that he was not given more power. That he is not known as Justice Merrick Garland is a testimony to the planning skills of Joe Biden.
As Attorney General, Merrick Garland does seem determined to make suffer those who voted for the man who filled the vacancy he thought would fill. In addition, it seems he wishes to preserve market conditions for his son-in-law to keep selling textbooks promoting critical race theory, and as such has decided that the counterterror assets of the United States government would best be focused on investigating the threat posed by parents voicing opposition to local school board policies promoting racial hate and sexual assault.
Once upon a time in America, the numbers on the pop and country record charts suggested that Americans supported an occasional rowdy school board meeting, as portrayed by Jeannie C. Riley in her hit “Harper Valley PTA.” I will borrow the tune to memorialize how the current Attorney General and almost-Supreme Court justice has responded to such a parental insurrection.
I wanna tell you all a story ’bout
A local county school district
and someone’s teenage daughter
Who attended there her local Junior High
Well, this daughter came home one afternoon
And she asked her parents “Why”
And her mom and dad are being watched now by the FBI
Well it seems that Mrs. Johnson went
And spoke before a meeting of the board
And from the look there on their faces
You could that every ox was getting gored
But they didn’t have an answer to the question
She asked them all that day
But they just signaled to the deputy
And said to take her microphone away
It was then that Mr. Johnson took his feet
And shouted “That’s not Right”
When the boys can use the girls room
It’s time to stand and fight
So they hit him with the TASER
Cause they really had to make him pay
‘cause that’s no way to talk

Well George Soros and the D A
Had let all of the felons leave the jail
To make room for Mr. Johnson who’d be held
And never granted bail
And though the video they took there
Shows he didn’t even make a fist
On CNN they show him as a famous
White Supremacist
Now the school board has protection and believes
It never made an error
And the Johnsons an example
Of white rage and domestic terror
So before you go address them
Better listen to what I got to say
