How can a president benefit from one of Donald Trump’s programs, and still get brownie points from his lunatic base for cancelling that program? Just cancel the program and then rely on the Supreme Court to reinstate it. We’ll call it the “have your cake and eat it too” gambit. Of course, the court has to play along. Unfortunately for old Joe, in the final days of the 2022 Supreme Court spring session, the court decided not to play along. It countered with the “up yours” gambit. By a 5 to 4 margin, the Supreme Court held that Joe Biden has the authority to manage boarder security. Joe Biden was the hardest hit by the decision.
In an effort to stem the flow of illegal aliens across our southern border, President Trump implemented the “Stay In Mexico” policy. It required asylum seekers to remain in Mexico, pending review of their applications. Biden naturally ended the program based on the sound reasoning that “orange man bad.”
Border states filed a lawsuit to prevent Biden from damaging the country – even to spite Donald Trump. They asked the court system to intercede and keep the “Remain In Mexico” policy intact.
Well, the case finally made its way to the Supreme Court, and it wasn’t having it. The court upheld the President’s authority to set immigration policies, regardless of how ignorant, misguided, and destructive such policies might be (elections having consequences and all). I’m not going to address whether this case was rightly or wrongly decided. I’m just going to point out that Joe Biden should be soiling himself – if he were smart enough to understand the electoral implications.
The border crisis is all Joe’s now. There will be no blaming the Supreme Court, Donald Trump, phantom white supremacists, or the tooth fairy. Joe won’t even be able to blame Vlad “the Mad Russian” Putin.
The Supreme Court gave President Gremlin free rein to manage our border. What results is up to him and him only – and we all know what will result – just as the country prepares to vote.
Illegal immigration is already near the top of voter priorities. All it will take is one reporter asking how a truckload of dead asylum seekers is better for the asylum seekers than remaining in Mexico, and immigration will vault to the top of the priority list. It will top abortion, the January 6 “mostly peaceful” insurrection, climate change, and rich people’s taxes. It may become a bigger voter concern than the trans grooming of children. Sorry, that’s the wrong terminology – the sexual healthcare of gender undecided prepubescent Americans. Depending on how bad things get, illegal immigration may even top mean tweets on the voter list of “must fix” issues.
If I read the Supreme Court’s ruling right, the court is saying, “Don’t expect the court to do the executive’s job.” Which is another way of saying, “Expect the executive to do the executive’s job. Whatever happens is between him and the voters.” Which is why Biden really needed the court to strike down his order. Instead, he has been granted the constitutional leeway to sink or swim, as determined by his own policies – and sink he will.

I wish there was a way that the Supreme Court could move to force the Executive Boss Hog to enforce all laws, which means he couldn’t just pick and choose, based on the political whim of the moment, don’t you? That’s something that should have been done before Jimmy Carter occupied the White House.
No doubt, this ruling does make it all on the “Gremlin’s” shoulders, which should help in the mid-terms, but until the day comes that the Republicans have a fool proof super majority in all of Congress, that gremlin will get his way, until the cows come home.
Laws passed are supposed to be enforced, not at the whim of the AOCs, and laws found to be unconstitutional are not to be thumbed by state governors.
We are living through an ongoing constitutional crisis.
