In the military and private sector, great managers realize that work should be handled directly by the group best suited to do the job. Indeed, if any boss micromanages, that causes a moral issue within the workforce and severely hurts the efficiency of completing the task at hand.
The Framers of our government understood that axiom. They understood that local governments had handled roads, buildings, water, bridges, education, farming, trade and all the other issues without assistance from the Crown, a Minister or a Lord. They also understood that as the Colonies expanded, representative delegates gathered periodically to make decisions regarding the postal needs, intra-state commerce, frontier defense, elections and the collection of revenue without the assistance of the Crown, the Ministers or the Lords.
Yet, the Framers understood that there must be an umbrella over the Nation where specific duties were performed by the federal government. The Framers knew that national defense was a key issue, and that there needed to be a regularity to the arrangements between the States. They also knew that there were certain rights of man that were continually violated by governments; Ex post facto laws, the writ of Habeas Corpus and Bills of Attainer were outlawed. They also understood that there needed to be a Supreme Law of the Land, with Appeal processes to ensure the justice of the outcome.
As former President Obama once stated, the US Constitution is a series of negatives, for it does not let the Federal Government do much!! Dah!! That was the intent. The Framers did not want to include the definition of any Natural Rights, for they were self-evident. In a free society, it was understood that natural rights should never be infringed by government. But the Framers were wise and understood that all governments morph over time, so they accepted a Bill of Rights that put huge negatives on the Federal Governments power to change the God-given rights. And Obama did not like that. And neither did Franklin Roosevelt, who floated the Four Freedoms: Freedom of Speech, Freedom of Worship, Freedom from Want and Freedom from Fear.
Supreme Court Justice RB Ginsberg remarked that the South African Constitution was the best written document in the history of man. She admired it and thought that the US Constitution should be more like the South African. Have you read it? There is a preamble, fourteen Chapters with 244 total Sections, eight schedules and then the Amendments. A printout in 9-font takes over 182 pages, while the US Constitution take less than 10 pages, including the Amendments.
The Preamble is something out of a Progressive marxist guidebook: We, the people of South Africa, recognize the injustices of the past, honor those who suffered for justice and freedom in our land, respect those who have worked to build and develop our country, and believe that South Africa belongs to all who live in it, united in our diversity. We therefore through our freely elected representatives, adopt this Constitution as the supreme law of the Republic so as to –
- Heal the divisions of the past and establish a society based on democratic values, social justice and fundamental human rights.
- Lay the foundations for a democratic and open society in which government is based on the will of the people and every citizen is equally protected by law.
- Improve the quality of life of all citizens and free the potential of each person
- And Build a united and democratic South Africa able to take its rightful place as a sovereign state in the family of nations.
What does the Preamble even mean? It seems that the Preamble is taking complete responsibility for the wellbeing and happiness of all the people, which accounts for the length of the document.
It was difficult to determine the role of the local governments or larger regional governments, for the responsibility of the fairness and happiness of the Preamble seems to lay within the National Government. One could say that the South African makes the government top-heavy, with all command and control from the top!
Sorry, Justice Ginsberg was very wrong, perhaps she was sick. The American people could not live under the South Africa Constitution, which is probably why so few, if any, elite Americans have moved to South Africa.
But beware! And the past few decades, the US federal government has morphed to an enormous size, with all the funding provided by the taxpayer and printing presses. A republic was not meant to have the massive overreach of a federal government. As with the South African Constitution, the federal government is taking control of all definitions, all policies and all programs, providing carrots to the local governments for compliance.
The Framers understood finances and human responses. The Framers understood that when tasks are discussed, planned and completed at a local level, the overall cost was lower and the participation of the local citizens was higher, for it was their responsibility to get the job done.
The Framers also understood that as responsibility for the task drifted further away from the source, the financial burden increased and local public support waned.
A limited government does not dictate educational standards. A limited government does not dictate energy production, that is controlled by demand. A limited government does not create massive programs based on the scientific findings of a few but rejected by the many. A limited government does not interfere with local elections, even with federal implications. A limited government does not use taxes from one State to enable another State to be fiscally irresponsible. A limited government does not dictate an energy policy that will destroy the livelihood of working Americans. A limited government does not need the largest support structure in the world to accomplish its mission, unless that government has taken control of all aspects of life.
Freedom is dependent on a limited government, one that does not formulate rules for everything. And freedom includes the right of choice, meaning a limited government does not establish a group to track down all those that have refused to receive an experimental vaccine.
