Around a week after the Trump electoral landslide, one anti-Trump Judge showed an unbelievable display of disrespect for the American people. Judge Michael Luttig, who has spent years obsessed with getting Trump (promoting all legal cases against Trump and using the most vicious hyperbole possible against the man), had this to say about the American people at a panel hosted by the Society for the Rule of Law: “The American voters do not care about who, as an individual, is in the White House.
They don’t care, in this instance, what this man has done for the past eight years; they could care less. He’s the first American President to ever be indicted for grave crimes against the United States of America…… They don’t care about any of this…. For the first time in American history, an American President has corrupted democracy itself and the rule of law in America, and gotten away with it, on Nov. 5, 2024.” Michael Luttig was given the honor of becoming a Federal Judge at a young age, and spent years making life-altering decisions in the cases brought before him. He should be thankful and humbled to America for that honor. It’s time for Luttig and other such elites to show the respect they demand for themselves and accept the decision of the American people.
Judge Michael Luttig has been in the public eye a great deal over the past few years. He is the first American Federal Judge to have stigmatized half of America (allies and those who supported Trump) as a “clear and present danger” for preparing to “attempt to overturn that 2024 election in the same way that they attempted to overturn the 2020 election, but (to) succeed”
Using the phrase “clear and present danger”, particularly as Luttig did in front of Congress, has critical legal consequences as Judge Luttig would know. From the 1919 case of Schenck v. United States, “clear and present danger” allows for an American to be deprived of certain critical Constitutional rights due to danger to the nation. After this despicable derision of Trump supporters to Congress, Luttig joined with rabid anti-Trump lawyer George Conway in a new legal group to “fight the Trump threat”. This involved constant barrages against Trump while Trump was a private citizen. Luttig was a continual fixture on the anti-Trump networks like far-left MSNBC slamming Trump with his legal “opinions”.
Starting in 2023, Luttig joined the legal onslaught against Trump. He was the main force pushing the extreme position Trump should be barred from seeking reelection due to the “insurrection clause” and Trump’s alleged effort to overthrow the government. The “insurrection clause” of the 14th Amendment passed in 1868 was directed at former Confederates who had previously served in Federal US office but joined in the Confederacy. Nothing close to what happened with Trump on Jan 6. Luttig attempted to use his perceived authority as a former Federal Judge to assert that his fringe theory was unimpeachable. Luttig went so far was to tell Ali Velshi on MSNBC “Section 3 of the 14th Amendment simply could not be any clearer that the former president is disqualified from the presidency as the Colorado Supreme Court held,” Ali Velshi When the case went to the Supreme Court, Luttig allowed arrogance to trump better judgment “The Supreme Court finds itself in a very precarious position today,” Luttig told MSNBC. “Undoubtedly, it doesn’t want to decide this case, and it will be looking for all legitimate off-ramps to decide that the former president is disqualified. But there are no legitimate off-ramps to that decision.” When all nine Supreme Court Justices ruled against Luttig’s theory, Luttig attacked even the liberal justices of the Court in a way similar to how he attacked the American people after electing Trump.
Unfortunately, Judge Luttig has gained further power in the legal field to condemn lawyers who disagree with him about Trump. This past year, he joined an American Bar Association (ABA) Panel that seeks partly to hold certain lawyers “accountable” if they represented President Trump in 2020 in election cases (and panelists like Luttig do not believe their legal theories were justified).
As the ABA leans to the political left, there is no such panel for deterring attorneys from taking a fringe position like that of Judge Luttig: Abusing the insurrection clause to disqualify political opponents. There are also no panels about prosecutors illegitimately using the power and discretion of the office to go after political opponents. The panel is solely against Trump lawyers.
Judge Luttig is an egregious example, but he’s not the only self-proclaimed “expert” to use perceived authority through a position of trust to get Trump. Through this election, the American people showed that they did not believe Judge Luttig’s theories were justified. He should accept the unanimous decision of the Supreme Court and the majority of his fellow citizens. America cannot have this happen again and it’s time to expose and hold accountable those who were involved. It’s about regaining the trust of Americans in our most important institutions. We are one nation under God and created equal with certain unalienable rights. It’s time that’s respected.
