Let’s Give Anthony Fauci Some Due Process

If any of the speculation about former Director of the National Institute of Allergy and Infectious Diseases Anthony Fauci’s role in the COVID pandemic is true, it will turn out to be far too big of a scandal to have been kept hidden behind a curtain of propaganda indefinitely. To do so would violate Lincoln’s axiom that “You can’t fool all of the people all of the time” – forever. Well, the curtain is about to be pulled back. Director of National Intelligence Tulsi Gabbard has launched an investigation into how gain of function (GoF) research may have contributed to the pandemic.

Gain of function research – which Elon Musk calls maximization of death research – began as military bio-weapons research. But it transitioned into the creation of new viruses, for which vaccines could be developed. As HHS Secretary Kennedy recently explained, in 1973 President Nixon joined 180 other signatories banning GoF research, however an obscure clause of the Patriot Act exempted federal officials from prosecution, while still leaving the ban in place.

In 2014 President Obama reaffirmed America’s opposition to the research with the declaration of an executive branch moratorium on gain of function research. According to Kennedy, that’s when the research simply moved to the Wuhan Institute of Virology (WIV) in China.

As a result of his own investigation, Senator Rand Paul – who is also a medical doctor – alleges that Dr. Fauci funneled money through US-based EcoHealth Alliance to the WIV, for gain of function research – essentially laundering money through a third party to skirt the US ban on the practice. With the consensus solidifying (we do go by scientific consensus now, right?) that the pandemic was triggered by a Wuhan lab leak, it raises serious questions about the connection between GoF research and COVID-19 . Things may be getting very interesting indeed for Dr. Fauci.

DNI Gabbard intends to provide long overdue answers to questions left festering by the Biden administration.

  • Was research funded at Wuhan to skirt a US ban on gain of function research?
  • Was COVID-19 a product of NIH funded gain of function research at WIV?
  • Was the pandemic the result of a lab leak in Wuhan?
  • Did Anthony Fauci commit perjury when he testified under oath that the NIH had not funded gain of function research?
  • How much of our national COVID response was designed to hide NIH culpability in the pandemic?
  • Did Dr. Fauci obstruct justice via censoring lab leak theories?

I also have a few questions I hope she gets to.

How did Anthony Fauci’s net worth double during the 3 years of the pandemic? According to financial forms obtained by the watchdog group Open The Books, his personal financial holdings went from $7.6M in 2019, to $15M in 2023. Did Fauci profit from the pandemic response which he orchestrated?

If Fauci misappropriated taxpayer funds to conduct gain of function research, was a crime committed? When 1 or more persons inadvertently die because of a crime, it’s considered felony murder. I believe 7 million COVID deaths falls in the 1 or more range.

Does violation of presidential directives, government policies, and use of a lab with known security issues rise to the level of gross negligence? If so, the resulting casualties would be considered negligent homicide.

We may soon find out if Anthony Fauci committed a whole host of crimes ranging from perjury to some version of homicide. So why isn’t he lawyering up and keeping quiet? Because he was offered, and accepted a presidential pardon – which by the way, indicates knowledge of culpability. He can’t be prosecuted for any past crimes by the federal government – assuming a pardon signed by a swamp dweller using an autopen is a legal pardon.

But that doesn’t mean that the good doctor faces no future exposure. He can be subpoenaed and compelled to testify. Some legal scholars argue that with his pardon he has no right against self-incrimination. If placed under oath, he will have only three options:

  1. Refuse to testify and go to jail for contempt, just as Peter Navarro did.
  2. Lie under oath and go to jail for perjury which is not covered by the pardon. Or
  3. Tell the truth and potentially reveal his role in the biggest global scandal in history – possibly even exposing evidence that leads to other unpardoned crimes.

I’m not a lawyer, but I’d like to know:

  • Does a presidential pardon shield a recipient from civil liability? If guilty of negligence, could Fauci be sued for damages? [Google AI says a pardon does not shield one from civil liability.]
  • Does a presidential pardon shield the recipient from charges in jurisdictions other than the federal government? Could a state charge him with negligent homicide? [Google AI says that a pardon does not shield one from state prosecution.]
  • Does a presidential pardon shield the recipient from extradition to a country in which he committed a crime? [Google AI says that a pardon does not shield one from extradition to answer for crimes in other countries.]

That last question really got me wondering: Is there some other country out there that would like to have a negligent homicide discussion with Dr. Anthony Fauci? It turns out there could be a bunch of them – depending on the results of Gabbard’s investigation. For example: 4,230 Salvadorans died of COVID-19, and it turns out El Salvador has an extradition treaty with the United States. We’ll just need the Supreme Court to inform Judge Boasberg that he does not have the power to revoke international treaties.
