The sound of breaking glass awakens you in the dead of night. You instinctively grab your trusty shotgun, herd all family members into a single room and call the police. However, before the police arrive the intruder finds you and advances – the 2×4 he used to break your sliding glass door raised above his head. Fearing for your life and your family’s – you shoot him.
After a police investigation, the Grand Jury does not indict you – you are cleared of any criminal wrong-doing. Hungry for fame and/or fortune, lawyers representing the shootee – or his family if he’s deceased – commence a civil suit against you for one million dollars.
Not to worry. Your homeowner’s insurance has always handled auto accidents, wind damages and thefts – and, coincidentally, the policy covers liability up to a million dollars. Only this time, the company is sorry to report that your policy does NOT cover intentional acts. Had you accidentally or negligently blasted the perp, all costs and judgements would be borne by your insurance. But, since you don’t deny purposely shooting the intruder, your policy won’t pay for your attorney or awards against you. Solution: Separate self‑defense liability policy.

Texas has Constitutional Carry, and I’ve told countless people not to count on it. If you justifiably shoot a man breaking into your house at 0300, a lawsuit is a something you must be prepared for. US Lawshield and other companies provide legal assistance for a small fee (I want to say a little over 100 a year), but they will not insure you unless you have a License to Carry. So, get the LTC so you can get a lawyer. Also, look at a separate liability insurance policy to cover these matters. Plus, say nothing until your attorney arrives.
PS: Oops. Just noticed you mentioning the liability policy. My bad. But great minds think in the same gutter! 🙂
