Cui Bono? Judge Merchan. Quid Beneficium?

Cui bono? (Classical Latin: [kui̯ ˈbɔnoː]), in English “to whom is it a benefit?”, is a Latin phrase about identifying crime suspects. It depends on the fact that crimes are often committed to benefit their perpetrators, especially financially.

Well folks, we’ve arrived. We have finally joined the Third World of the Venezuelans and the Cubans. We’ve joined the statist world of the Lenins and the Stalins. District Attorney Alvin Bragg who campaigned on putting Donald Trump in jail, believes he is now one step closer to that goal. He followed the guidance of Josef Stalin’s Secret Police Chief, Lavrentiy Beria. Beria’s most famous quote, “Show me the man and I’ll find you the crime.

 This afternoon, a Manhattan jury found former President Donald J. Trump “guilty” on 34 counts of a. Crime to which the prosecution never disclosed until its final arguments. I don’t know why I was surprised. We all knew the fix was in. We could all see that the presiding judge, Juan Merchan, was obviously biased in favor of the prosecution, handing down one adverse decision after another, most contrary to black letter law.

The most egregious of these, was a jury instruction that told the jurors that they did not need to unanimously agree with all or any of 3 different underlying “crimes.” I put “crimes” in quotes because none of these were disclosed to the defense prior to the trial, which I’m given to understand by real litigators, is clearly reversible error.

Reversible “error,” is a term being bandied about since this trial began and even more-so  since the verdict came out. Pundits of all stripes (yes, even Democrats) have agreed that the trial is a sham and Merchan’s conduct of it is egregious.

That is not important. There is no doubt in my mind that this verdict will be overturned. Even from my lay viewpoint, I can see that this DA and “Judge” violated not only black-letter law, but also numerous constitutional protections mandated for the accused.

This open and notorious misconduct by the entire New York legal system, aided and abetted by the Biden Administration is an embarrassment. It should also be an embarrassment to Judge Merchan. 

Even the most politically driven Judge cares about his judicial reputation. He might be a hard core activist judge, but he still must pay attention to his “over turned on appeal” rate. He must also be cognizant of how his actions appear to whatever governing board is responsible for overseeing his conduct.

If he cares about keeping his seat, he can be partisan, but with circumspection. Merchan has displayed no such care in this case. It may take a while, but in the long term, Merchan’s judicial reputation will be destroyed and he knows this.

At the beginning we asked, “Cui Bono”…who benefits. That’s easy, the Democrats. Now I’m obligated to ask vis Judge Merchan: Quid Beneficium? What is the benefit Juan Merchan believes he will receive for his sordid conduct in this trial? To put point on it, what has the Democrat machine promised him? 

This is the question we should all be asking. This is what we should be investigating. What were the thirty pieces of silver he was paid to totally betray our judicial system? What was his price to flip our system upside down. How venal did he need to be in order to turn Due Process into a Stalinesque, show trial?

America wants to know.

  1. I’m not sure Merchan needed the thirty pieces of silver. He was sold from the start, that his job was to get Trump convicted, at any cost, and his jury instructions told the whole story. Not to mention his daughter, who fund raises for the Democrat party. I think, in this situation, Merchant was one of the pharisees who offered up their silver. Same for Bragg.
    I have no doubt, also, that this garbage will be overturned on appeal, maybe even at the state appellate level, but remember, if Trump goes to jail, everything will be up for grabs. There will be Hell to pay, at a time when we should be waiting to see what happens next, instead of watching a war start.

    Merchan is a true believer of the Democrat party. They could have simply told him that his daughter might lose her cushy job, if that.
    Our country is in uncharted territory.
