
Let’s say you’re a Democrat loyalist, serving the party as an undercover operative – hiding in plain sight as a judge. On a spring day in 2023 you’re offered a chance to serve your beloved party by convicting a political candidate, to influence a Presidential election. Such an opportunity to prove one’s value to the party – and fast track one’s career – is not likely to ever come again. So, you lift the blindfold of justice, and use your legal skills to tilt Lady Justice’s scales – ensuring the trial ends as the party wishes.
That is precisely what Justice Juan Merchan did with Donald Trump’s trial. By preventing the defendant from mounting a defense, and issuing jury instructions which led to only one decision – guilty of all charges. Naturally the judge had to commit a few “reversible errors” and violate his oath to get the job done, but even if the verdict is overturned on appeal, it won’t hurt his career. So long as Joe Biden stays in power, his enforcers at the DoJ will have Merchan’s back, and the party will reward him with future appointments. Besides, any consequence for violating an oath is for chumps.
But as the philosopher Woody Allen said: “Man plans and God laughs.” Juan’s career plans were tossed in a dumpster and set ablaze by a simple Presidential debate – of the sort that happens every four years. Suddenly Merchan discovered that his foolproof plan to secure the White House for Joe Biden had a serious flaw – Joe Biden. The man he expected to “cover his six” used the debate and two weeks of public appearances, to prove beyond a reasonable doubt that he’s unfit for any job requiring significant mental ability outside the hours of 10 am to 4 pm. Just as Merchan was preparing for the Donald’s jumpsuit fitting, the whole plan came crashing down. Now Merchan’s future is looking considerably less bright. Is that laughter I hear? I could have sworn I heard a brief chuckle, but I can’t tell where it came from.
Like a boatload of other party operatives, Merchan has decided that it’s time for plan B – every man for himself. He pulled the blindfold back down, and decided to play act being a real unbiased arbiter of justice – for a few months anyway. He announced that he will be considering the impact of the Supreme Court immunity decision with regards to the recent persecution prosecution of Donald Trump. Merchan scheduled a hearing on the subject for September 6. Naturally, that also meant that the “Honorable” Merchan had to delay Trump’s sentencing until later in September – if as he said, “it’s still needed.” That should give him time to see how the political winds are blowing before he decides whether to save Joe’s political skin or his own reputation.
Juan Merchan has given himself two months to watch President “Mumbles and Stumbles” failing to prove he has enough marbles left to read a teleprompter, and Donald “Convicted Felon” Trump climbing in the polls. Since Biden appears determined to crash and burn – as spectacularly as possible – I suspect Juan will use his two months to don his chute and look for a safe place to punch out of this crap show.
Unless Joe manages to pull out of his tail spin – and let’s face it, he ain’t Chuck Yeager – I expect Judge Merchan to invite the press cameras into his court room and announce:
- The Supreme Court decision makes it clear that much of the evidence used at trial was inadmissible.
- Therefore, he is declaring a mistrial and Donald Trump is a free man.
- This whole mess was caused by that buffoon Alvin Bragg, who apparently didn’t read the Constitution before indicting Trump.
- Luckily in his courtroom, the system works.
Then the Honorable Merchan will go home and wait to see who his party nominates before writing another donation check.
I don’t think Juan Merchan is either legally illiterate or mentally deficient. Whether or not he is politically astute will be determined in the next couple of months. It’s one thing to put one’s reputation on the line when the chance of future rewards is high. It’s quite another matter when betting on a certain loser.
We’ll see if the political landscape affects the Judge’s behavior and decision in September. Until then: the assurances of Chief Justice Roberts are comforting. I know I sleep better knowing that we don’t have “Obama Judges” and “Trump Judges” who would factor politics into the administration of justice (snark intended).
