Judge James Boasberg Delivers a Tar Baby to the Supremes

The Dems said that if we elected Donald Trump our democracy would be a risk … and they were right. Since we had the temerity to elect the Donald, the left’s rogue judges have decided that it’s their sacred duty to rescue us from the calamity of self-governance. Just as Chief Justice Roberts rewrote Obamacare, lower level judges have decided that they can rewrite Article II of the Constitution.

District judges are ordering the President of the United States to

• Continue wasteful and corrupt spending of taxpayer dollars,
• Provide lifetime employment to bureaucrats who won’t even show up for work,
• Enlist the mentally ill into the military, and
• Cease removing foreign terrorists and criminals from the country.

Those district judges are unlawfully seizing Constitutional power from our duly elected leader. I believe the term for that is a “coup.”

It’s been obvious since Trump’s first term that district judges think they can grant themselves executive (i.e. Article II) powers over the entire country. As such, they are the actual threats to our democracy. So far they’ve gotten away with it because Chief Justice John Roberts is more concerned about attacks on his court than attacks on the Constitution which he is sworn to defend – making him derelict in his duty. Roberts is now covering for the district judges, telegraphing that he would prefer to not take corrective action against lower courts. Hence, we find ourselves in our current constitutional crisis. A coequal branch of our government is insisting that it is the superior branch, and refusing to honor our pact of self-governance – the United States Constitution.

Our slide into banana republic territory will only be arrested when the Supreme Court forces the judiciary back into its Article III lane. If only President Trump could find a district judge willing to make a ruling so absurd that Chief Justice Roberts couldn’t ignore it without making the Supreme Court look derelict (delegitimizing it in the eyes of the public). Luckily, U.S. District Judge James Boasberg has risen to the challenge.

In the ultimate act of hubristic idiocy, Judge Boasberg ordered the President to ignore his constitutional duties, and stop deporting alien terrorists belonging to the violent gang Tren de Aragua. He further ordered that any such criminals already incarcerated in El Salvador be returned to the United States forthwith. Apparently, the megalomaniac thinks his authority covers Latin America as well. The judge even threatened the President of the United States with contempt of court if he fails to comply.

Judge James’ order shows that he is maliciously anti-democratic, legally illiterate, strategically moronic, or all three. He may also be just the guy who will make Chief Justice Roberts look stupid(er) if he lets this nonsense continue.

For all the left’s caterwauling about Trump being a “threat to democracy,” it is Trump who is trying to keep his promise to the voters. He said he’d fix our illegal immigration crisis, and that is what he is doing. By commanding the President to stop, Boasberg is attempting to overturn the election result. Isn’t that a bit insurrectiony? Is Chief Justice Roberts concerned yet?

Of course, it’s possible that Judge Boasberg is legally illiterate. He was appointed by Barack Obama after all. In the world of Democrat party appointments, it would be silly to assume professional competency or integrity. It’s possible Boasberg hasn’t read the Constitution which he is sworn to defend. Why bother to read it if you don’t intent to follow it?

Clearly Judge Boasberg doesn’t understand the notion of coequal branches of government. The executive branch has just as much constitutional power as the judiciary. The Constitution only works when the three branches of government play nice with each other and respect each other’s authority. It falls apart when the branches go to war, as judicial members of the “resistance” have just declared. When judges like Boasberg claim they have superior power over a coequal branch of government, they are begging the other branches to demonstrate otherwise. Shouldn’t a declaration of war on two other branches of government concern Roberts?

Boasberg is also a bit behind in his reading of recent Supreme Court decisions. He seems to have missed the gift that Jack Smith gave the Donald – a Supreme Court decision that the President has absolute immunity while performing the duties of his office. Boasberg can bloviate all he wants about holding the President in contempt, but his power over the President is dependent on the President’s voluntary compliance. He shouldn’t be surprised when “voluntary compliance” ends at the boundaries of Boasberg’s Article III authority.

Only Congress can stop a President who refuses to comply with a court. Its mechanism to do so is impeachment. Does Judge Boasberg really think Congress would remove a President for refusing to import foreign murderers and rapists into the country? Would the Democrats even want to touch that tar baby?

Special Counsel Jack Smith was a strategic moron for insisting that the Supreme Court resolve the issue of Presidential immunity. He got his decision, and now Donald Trump can’t be touched by the criminal justice system while doing his job. Maybe Boasberg can save Smith from being the worst strategic thinker of all time by forcing the Supreme Court to resolve the “district judges can grant themselves authority over the world” controversy.

The Boasberg ruling re Tren de Aragua places a rather unavoidable question before the Supreme Court. Does a district judge have the authority to populate the United States with criminals? It’s really that simple. With Boasberg’s order, has judicial “resistance” reached a level of absurdity which the Supreme Court can’t ignore? Is Boasberg backing the Supremes into a corner: defend the Constitution or be recognized as a bunch of unprincipled hacks? Has Chief Justice Roberts figured out yet that the court’s only real power is moral authority, and it is being tested by Boasberg?

Perhaps in a couple of years, after this as all been resolved, Donald Trump will be freed from the radical lawfare which has been slowing his progress. Then the lefties can thank Judge James Boasberg for issuing a ruling so ridiculous that the Supreme Court was forced to do its job.
