Obama District Judge Paula Xinis is madder than Joe Biden after being asked an unscripted question. She directed the Trump administration to open a federal coyote ring, and get busy smuggling illegals into to the United States. The Donald has been less than enthusiastic with his compliance, and she is mightily offended by his lack of deference to her court.
After Tom Homan – the most admired law enforcement officer in America – arranged a homecoming for Kilmar Ábrego García (a Salvadoran wife beater with alleged gang ties, who was illegally in America), Judge Xinis was miffed. Apparently, she wasn’t convinced of Garcia’s gang ties (even though two other courts had ruled on it) and didn’t give a rip about immigration laws enacted by Congress. She demanded that the Department of Justice, the State Department, and if necessary, the Department of Defense, take all necessary steps to go get Garcia from his country of citizenship and return him to the good ole US of A. That would be a district judge ordering the President to break the law. She’s apparently not legally literate enough to see the problem with that.
That of course prompted Attorney General Pam Bondi to send a quick note to the Supreme Court which translates as: “Your dog is crapping on the President’s lawn. Would you please do something about it?” Naturally Bondi – being smarter than Xinis – said it in a more lawyerly fashion than that.
The Supreme Court, led by the ever-duty-dodging John Roberts, was not inclined to roll up a newspaper and swat Xinis on the nose – she is vicious after all. Instead, they decided to encourage their snarling attack dog to reconsider her actions. The court asked Judge Xinis to clarify what she meant by “effectuate” Garcia’s return.
Judge Xinis gave it a nano-second of thought, and clarified what she meant by “effectuate.” It meant for President Trump to do whatever the hell he needed to do, to remove Garcia from his home country, and get him back on U.S. soil … pronto. Oh, and report to her everyday what was being done to “effectuate” that.
Apparently, the Supreme Court saying “Bad dog” didn’t make much of an impression on Judge Xinis. Now she’s threatening to hold a contempt hearing for officials of the Trump administration – though there may be some scheduling conflicts with Judge Boasberg on that front.
I think Judge Xinis (and for that matter Judge Boasberg too) should have kept up on her Supreme Court decision reading. You see, AG Bondi and her staff are working under the authority of the President, and thanks to Special Counsel Jack Smith, the Supremes clarified that the President has absolute immunity while performing the duties of his office. That includes things like “Taking care that the laws be faithfully executed.” That’s written in Article II, Section 3, of an obscure document called the Constitution. Judge Xinis should read it sometime – she can get a free copy from Hillsdale College if there isn’t one in her law library.
I suggest that tonight, after a hard day of ignoring congressional legislation and the will of the people, the not particularly honorable Judge Xinis should pour a brandy and settle in for a night of light reading. I recommend that she skip Rules for Radicals and Dreams From My Father, and read some of John Roberts’ work instead. He’s the guy that wrote the decision which she’s obliged to follow now – assuming she cares.
So, what’s next in the matter of Kilmar Ábrego García? Let’s presume that Xinis goes ahead and steps on that rake lying in the grass, and holds a contempt hearing. Surely, she’ll penalize somebody in the business of protecting America. Otherwise, what’s the point of stepping on the rake. But has she thought about what comes next?
Does Judge Xinis really think she can write an opinion that will convince the Supreme Court that they got that whole immunity thingy wrong?
Does she think that AG Bondi will enforce her penalty against AG Bondi? I believe Eric Holder and Merrick Garland have already created an elegant solution for that conundrum … which Xinis won’t care much for.
Finally, does she think a Democrat functionary such as herself, ordering the importation of violent illegal criminals, is going to help the Democrats in the midterms?
Just saying, it doesn’t seem like Judge Xinis has checked where the road she’s chosen leads. If she had, perhaps she’d realize that she she’s approaching a cliff, not the horizon.
The reality is that the only authority any Article III official has over an Article II official, is moral authority – which Xinis sacrificed when she decided to use her bench to serve a political party rather than the Constitution she is sworn to uphold.
