Judge Boasberg, In Hot Pursuit of His White Whale

Now that he isn’t passing maximum sentences on January 6 selfie photographers any longer, Obama Judge Jeb Boasberg has some spare time on his hands. Rather than take his wife Elizabeth (who may actually be a woman) on an ocean cruise, he decided to dabble in Article II of the Constitution – the part where the President is charged with enforcing laws … such as those for immigration.

Jeb ordered the Donald to turn around a couple of airplanes – in midflight – and get busy coyoting a few hundred criminal aliens back into the good ole US of A. Naturally, President Trump wasn’t particularly keen on the idea, given that 77,303,568 Americans were insisting that he do otherwise. Since Trump understands his job (serving we the people), he told Jeb to go pound sand.

That conflict backed the Supreme Court into a self-created corner. When the left started howling “constitutional crisis” the Supremes (the egomaniacs not the singers) reluctantly decided to act. They sent Judge Boasberg a Google Maps pin and reminded him that his district – Washington DC – is not in Texas, and that he has no jurisdiction over detainees in the districts of other judges. They didn’t seem to think it was necessary to mention that immigration policy wasn’t his job either. Jeb curtly responded, “Fine, but I’m holding somebody in contempt anyway.”

So, this is where we are: Judge Boasberg intends to hold the Justice Department in contempt, for refusing to break the law, on a case that he wasn’t supposed to take. Nothing megalomaniacal about that is there?

Jeb announced that he is calling on the DoJ to prosecute the DoJ for criminal contempt. Of course, he has one little problem in that request … which I call the Garland precedent. That’s where the Attorney General declines to prosecute the Attorney General, because, you know, … she can.

Not to be ignored by a coequal branch of government, Jeb came up with an elegant workaround. He’ll appoint his own prosecutor. Perhaps Andrew Weismann is available. Boasberg’s own employee can then argue the case before him, so that he may adjudicate it in a completely fair and unbiased fashion. I wonder if he’ll give his prosecutor a bonus for winning the case? Of course, Jeb will also have to appoint a SWAT team and a few corrections officers to handle the inevitable arrests and incarcerations.

It has all left me to wonder: With that amount of authority, why is Judge Boasberg playing such “small ball”? Does he really care what happens to Tren de Aragua, when he could do so much more for the Democrat party humanity? As long as he’s making up crap that he thinks he can do, why doesn’t he cancel the tariffs on China, hire a contractor to tear down the border wall, and bump up the debt limit a tad bit? He should check with Hakeem and Chucky to see what they’ve got on their wish lists. I’ll bet they have a few great ideas for him.

But there is one little issue that Judge Boasberg hasn’t considered. We are a self-governed constitutional republic. We agree to be governed, if those governing us comply with our pact of civilized behavior – the Constitution. When one or more branches of our government breaks that pact, those with the real power – we the people – may withdraw our consent to be governed. We Americans can be very defiant of authority when we don’t trust the government. Just ask the Brits – they’ve experienced it first-hand. Boasberg needs our trust – even while he gives our emissary his middle finger. Yet, he seems unconcerned about notions of self-governance, and his role in our republic – not while there’s a white whale that needs to be harpooned.

It’s obvious that Judge Boasberg isn’t up on the nuances of our Constitution, but apparently, he hasn’t read much Melville either. If he had, he might realize that hubris combined with blind hatred is a recipe for self-destruction. How will Chief Justice Roberts keep his Article III fleet afloat, with so many Judge Ahabs anxiously sacrificing their ships in service to their TDS fueled obsessions?
