It’s only Wednesday (as I write this) and two more federal judges have decided to join the resistance — making a mockery of their oaths to stop the chief executive from performing his Article II duties. “Obama Judge” Rudolph Contreras (the same activist who issued FISA warrants against the Trump campaign in 2016) issued an injunction prohibiting the President from imposing tarrifs. “Biden Judge” Jia Cobb issued an injunction prohibiting the President from firing Federal Reserve Governor Lisa Cook (the judge’s sorority sister).
These two are just the most recent cases of activist judges joining the resistance to slow the Trump juggernaut. But are they effectively blocking his every move, or playing into his hands? Are the Dems fighting a myriad of battles, while the Donald is fighting a war? Who wins when Chief Justice Roberts is forced to accept that there really are “Obama judges” and “Trump judges”?
The Democrats have decided to start fights over DEI, transgender rights, foreign aid, government job security, Article II agency independence, alien residency rights, and criminal rights. Their chosen battlefield is the District Court system, and resistance judges are happily engaging to block each of the President’s executive actions.
The Donald however is fighting a war over who is in charge of this country: unelected judges and bureaucrats, or “we people.” He’s fighting it by picking an 80/20 issue, and triggering the Democrats into hate fueled, ill-advised lawsuits — exposing activist judges in the process and backing the Supreme Court into a corner. It’s a corner the Supreme Court can only get out of by making decisions that the Chief Justice would prefer to avoid.
The district judges are forcing the Supreme Court to reconcile:
- Do alien criminal gangs have a right to prey on Americans, or does the President have a right to enforce immigration law?
- Do men have a right to ogle naked girls in their locker rooms, or does the President have a right to defend the privacy of all Americans?
- Do bureaucrats have a right to lifetime employment, or must they earn their pay?
- Do Article II agencies have a right to defy the Article II executive?
- Do Columbian transgender opera singers have a right to our tax dollars, or does the President have a duty to manage foreign affairs?
- Do district judges have the right to defy legislation and the Constitution, or are they bound by them?
Chief Justice Roberts defended the lower courts 8 years ago, claiming that there are no “Obama judges or Trump judges.” The lower courts have rewarded him by publicly exposing him as a fool. Is that why President Trump seems to be piling up a lot of Supreme Court decisions reaffirming the powers of the President?
While the Democrats have been engaged in battles of “resistance” — slowing the President’s progress — has Trump been preparing the field of battle for the final fight? Will a future President Vance or DeSantis fight on ground chosen and prepared by President Trump. What will the next President be able to accomplish with undisputed power to
- Enforce all laws everywhere,
- Hire and fire federal employees,
- Set foreign policy,
- Hold judges, politicians, and bureaucrats accountable to the law, and
- Decide how to spend the funds Congress appropriates,
The Trump Presidency will no doubt have many more accomplishments in the future. He may even manage to make the Supreme Court do its job and defend the Constitution as written.
